Businesses, 2022 Customs Tariff Impacts Validation of Advance Rulings and National Customs Rulings

If you are a business who currently holds an advance ruling or national customs ruling for tariff classification or origin, then be aware that it may not be valid when the 2022 Customs Tariff comes into effect on January 1st, 2022.

Canada Border Service Agency (CBSA) has published Customs Notice 21-20 advising on how to request the validation of a tariff classification advance ruling, tariff classification national customs ruling, and advance ruling or national customs ruling for origin, should the tariff classification or origin of the ruling be impacted by changes in the January 1st, 2022 Departmental Consolidation of the Customs Tariff.

Recipients of a ruling should review the Customs Tariff 2022 – Concordance, to determine if the tariff classification and/or the origin (when applicable) of the goods subject to the ruling may be impacted by changes to the January 1st, 2022 Customs Tariff. The Concordance Table can be found here.

Where the tariff classification and/or the origin (when applicable) of the goods subject to a ruling may be impacted, the CBSA strongly recommends that ruling recipients submit a request for validation of a ruling to the CBSA.
