Lacey Act Phase VI Delayed

The United States Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) announced the delay of the July 1, 2021 Lacey Act Phase VI enforcement schedule until October 1, 2021.

APHIS narrowed the list of Phase VI affected products, and clarified the declaration requirement will not apply to used, recycled, or reclaimed pallets or to pallets, empty or under load, that are used to carry goods imported into the United States.

The Lacey Act makes it unlawful to import any plant or plant product that was illegally harvested and unlawful to import certain products without a declaration.

Lacey Act requirements may be found on APHIS’ website.
