The Pest Control Products Act(PCPA) requires that all pesticides imported into Canada be registered by Health Canada, except in certain specific cases provided for in the regulations.
Pest control products exempt from the Regulations are listed in Part 3(1) of the Pest Control Products Regulations.
Registered pesticides must have a bilingual (English/French) label approved by Health Canada.
Registration status can be confirmed using:
- Health Canada’s Label search tool or
- The Pesticide product information database
Commercial importers must provide detailed information to the Canada Border Services Agency (CBSA), including:
- The name and complete contact information of the shipper and importer
- The name and description of the pesticide
- The name of the active ingredient and its concentration
- The registration number or the certificate number and the type of the pesticide certificate • The words “exempted” or “scheduled”, if applicable
- The intended use, such as manufacturing, resale or research
The Pesticide Compliance Program (PCP) is responsible for promoting, monitoring, and enforcing compliance with the PCPA. PCP compliance and enforcement officers conduct inspections at the border, to verify compliance with the PCPA.
Any person or business importing a pesticide that does not comply with the PCPA may be subject to enforcement actions in accordance with Health Canada’s Pesticide Compliance and Enforcement Policy.
Additionally, contraventions found to the Customs Act may be subject to enforcement actions by the CBSA.
