FCC Confirms Form 740 Remains a Requirement until July 1, 2016

The U.S. Federal Communication Commission (FCC) Office of Engineering and Technology has issued a Public Notice to address misconceptions about electronic filing requirements for FCC Form 740 – Statement Regarding the Importation of Radio Frequency Devices Capable of Causing Harmful Interference (FCC Form 740).

The Form 740 declaration is currently filed electronically in a customs broker’s entry summary transmission to Customs and Border Protection (CBP) using information supplied by the importer or ultimate consignee.

The FCC issued the Notice as a clarification of its plans to waive the requirements when the Automated Commercial System (ACS) is shut down and the use of the Automated Commercial Environment (ACE) is required for electronic filing.

Per the FCC Notice, the trade community is to continue to file FCC-required information electronically with CBP via an ACE-Entry Summary or any other process that may be designated by CBP until the waiver provision takes effect on July 1, 2016.
