CBSA completes whole potato expiry review investigation

On April, 29th, 2015, the President of the Canada Border Services Agency (CBSA) completed the investigation of the expiry review of Certain Whole Potatoes and has made the determination that the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods.

The subject goods are described as: Whole potatoes originating in or exported from the United States for use or consumption in the province of British Columbia, but excluding:

Imports during the period from May 1 to July 31 (inclusive) of each calendar year;

  1. Seed potatoes;
  2. Red potatoes;
  3. Yellow potatoes;
  4. Exotic potato varities; and
  5. White and russet potatoes imported in 50-pound cartons in the following count sizes: 40, 50, 60, 70 and 80.

These goods are generally classified under the H.S. classifications 0701.90.00.10 & 0701.90.00.20.

Additional details concerning the determination made by the President can be found in the Statement of Reasons which will be issued within 15 days and can be found on the Canada Border Services Agency’s web site.

The Canadian International Trade Tribunal (Tribunal) is conducting an inquiry to determine whether the expiry of the order is likely to result in injury or retardation to the Industry. Their decision will be issued no later than September 10th, 2015.
