Notice of Expiry of Finding on Silicon Metal from China

On August 27, 2018, the Canadian International Trade Tribunal (CITT) gave a Notice of Expiry of the finding made on November 19, 2013, concerning the dumping and subsidizing of on Silicon Metal originating in or exported from China.

Under the Special Import Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expires five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The subject goods are described as “Silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes”. Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the CITT on or before September 12, 2018.

On September 13, 2018, the CITT will distribute the list of participants. The deadline for filing submissions is September 21, 2018. If there are opposing views, each party may file a response no later than October 2, 2018.

Documents should be filed electronically through the CITT Secure E-filing Service. Only one electronic copy is required.

The CITT will issue a decision on October 16, 2018, on whether an expiry review is warranted. If the CITT decides that an expiry review is not warranted, the finding will expire on its scheduled expiry date. If the CITT decides to initiate an expiry review, it will issue a notice of expiry review.
