New Exclusions Granted for China Section 301 List 3 & 4A Products

March 13, 2020 – The U.S. Trade Representative (USTR) granted a tenth round of exclusions from Section 301 additional duties being assessed on imports of Chinese origin products found on List 3, and as well as the second round for List 4A.

For List 3, the below five complete 10-digit Harmonized Tariff Schedule (HTS) numbers were excluded:

  1. 3923.21.0030
  2. 3923.21.0095
  3. 3926.20.9050
  4. 4015.19.1010
  5. 5603.12.0090

These exclusions cover 75 separate exclusion requests, and are effective September 24, 2018, though August 6, 2020, using HTS number 9903.88.41. They are applicable to anything classified in these HTS.

For List 4A, exclusions were granted for nineteen specific product descriptions, covering 39 separate exclusion requests. They are effective September 1, 2019, through August 31, 2020, using HTS number 9903.88.42. These exclusions may be used if your product matches the specially prepared product description, even if you did not apply for the exclusion.

Refunds for duties previously paid, which are now excluded, may be applied for using a Post Summary Correction (PSC) for unliquidated entries; or a Protest for entries liquidated within the past 180 days.

Importers should contact their Livingston Service representative to request any applicable PSCs or Protests be filed.
