Japan applies agricultural safeguard on processed pork from Canada under CPTPP

On November 13, 2022, Japan submitted to Canada a Notification of Agriculture Safeguard Measures for processed pork. As per Japan’s Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) tariff schedule, Japan can apply a safeguard measure on imports of processed pork from a specific CPTPP Party if imports from that Party exceed an established threshold.

  • (b) in Year 3 through Year 6, Japan may apply an agricultural safeguard measure under this Section on SG3 goods from an individual Party only if the aggregate volume of imports of SG3 goods from that other Party for the respective year exceeds 118 per cent of the largest annual aggregate volume of imports of SG3 goods from that individual Party during any of the preceding three fiscal years.

Therefore, Japan will apply an agricultural safeguard measure to processed pork (HS Code 160249) from Canada as of November 1, 2022, until March 31, 2023. To note, the safeguard measure was likely triggered as Japan’s imports of processed pork from Canada were NIL in each of the previous years.
