Government of Canada Initiates SIMA Inquiry on Nitisinone Capsules

On September 21, 2018, the Canada Border Services Agency (CBSA) announced that it has launched an investigation under the Special Import Measures Act (SIMA) respecting the alleged injurious dumping of certain nitisinone capsules from Sweden.

The investigation follows a complaint filed by Laboratoires KABS Inc. and MendeliKABS Inc.

Subsequently on September 24, 2018, the Canadian International Trade Tribunal (CITT) gave notice that it has initiated an injury inquiry to determine if the alleged dumping of the nitisinone capsules specified above has caused injury or retardation or is threatening to cause injury to Canadian manufacturers.

The goods being investigated are described as capsules and tablets of nitisinone with a dosage of 2 mg, 5 mg, 10 mg and 20 mg, whether or not they are packaged for retail, originating in or exported from Sweden.

The subject goods are usually classified under HS classification numbers 3004.90.00.79, 3004.90.00.90 or 3003.90.00.90. However, these classification numbers are for ease of reference only. Refer to Appendix 1 of the CBSA notice for the authoritative details regarding the subject goods.

Parties wishing to participate in the preliminary injury inquiry must file a notice of participation with the CITT on or before October 4, 2018.
