Government of Canada Initiates Expiry Review concerning Silicon Metal

On October 15, 2018, the Canadian International Trade Tribunal (CITT) initiated an expiry review of its finding of injury made on November 19, 2013 concerning the dumping and subsidizing of Silicon Metal.

On October 17, 2018, as a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the above finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

The CBSA will make a determination no later than March 15, 2019, and will issue a Statement of Reasons by March 29, 2019.                    .

The subject goods are described as silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the People’s Republic of China.

The silicon metal is classified under tariff item 2804.69.00.00. The HS code is provided for the convenience of reference only. Please refer to the product definition for authoritative details regarding the subject goods.

As part of its expiry review investigation, the CBSA has forwarded questionnaires to Canadian producers, importers, exporters and to the Government of China.
