CFIA Notice on the Amendment to the Canadian Food Inspection Agency Fees Notice

The Canadian Food Inspection Agency recently issued a notice to industry regarding an amendment CFIA Fees Notice (CFIA Fees Notice) sets out the fees that have been fixed by the Minister of Health under subsection 24(1) and section 25 of the Canadian Food Inspection Agency Act for services or the use of a facility provided by the CFIA or in respect of products, rights and privileges provided by the CFIA.

Due of the coming into force of the Safe Food for Canadians Act (SFCA) and the Safe Food for Canadians Regulations (SFCR), changes to parts of the CFIA Fees Notice are required to implement the licensing regime and to align it with the language and authorities in the SFCA and the SFCR. The amendments fall into three main categories:

  1. Addition of the SFCR licence in all food commodities and conversion of any existing establishment registration fees (where applicable) into fees for establishment inspections. For food commodities not previously federally regulated, the new Part 17 — Other Food Commodities Fees has been added to the CFIA Fees Notice. These changes allow for cost recovery for licences issued under the SFCR.
  2. Updates to wording and references, by replacing language and references taken from existing food-related acts and regulations that will be repealed on January 15, 2019, with the wording and references found in the SFCA and the SFCR. These changes are minimal and the CFIA anticipates that costs will remain as stable as possible for stakeholders.
  3. In instances where authorities no longer exist for the CFIA to continue to provide a service, these services and their associated fees have been removed.
