Le 11 janvier 2016 marquait le d\u00e9but de la p\u00e9riode de sanctions p\u00e9cuniaires, ce qui signifiait que les transporteurs qui omettaient de se conformer aux exigences relatives au Manifeste \u00e9lectronique pouvaient recevoir des sanctions administratives p\u00e9cuniaires (SAP).<\/p>\n<p>En raison de l\u2019instabilit\u00e9 r\u00e9cente du syst\u00e8me de l\u2019ASFC, une p\u00e9riode d\u2019\u00e9valuation de 90 jours entrera en vigueur \u00e0 compter du 29 mai 2017, ce qui permettra aux transporteurs routiers qui se pr\u00e9sentent \u00e0 la fronti\u00e8re sans l\u2019information pr\u00e9alable sur les exp\u00e9ditions commerciales (IPEC) de retourner aux \u00c9tats-Unis et d\u2019attendre la transmission des donn\u00e9es sur le moyen de transport et le fret.<\/p>\n<p>Ces cas seront partag\u00e9s avec l\u2019Unit\u00e9 de conformit\u00e9 des transporteurs, qui surveillera la fr\u00e9quence des retours et communiquera avec les transporteurs qui continuent de ne pas fournir l\u2019information requise pour am\u00e9liorer la conformit\u00e9.<\/p>\n<p>L\u2019ASFC pr\u00e9voit que cette p\u00e9riode de 90 jours devrait aider les transporteurs routiers les plus \u00e9prouv\u00e9s par les pannes de syst\u00e8me en raison de leur proximit\u00e9 de la fronti\u00e8re. Le fait d\u2019accorder plus de temps aux transporteurs leur permettra de mieux comprendre les effets de leur non-conformit\u00e9 et leur donnera une occasion de prendre des mesures correctives et d\u2019adapter leurs pratiques commerciales afin d\u2019\u00eatre pr\u00e9par\u00e9s \u00e0 faire face \u00e0 d\u2019autres pannes de syst\u00e8me.<\/p>\n<p>Nous rappelons aux transporteurs qu\u2019ils ont l\u2019obligation de transmettre par voie \u00e9lectronique des donn\u00e9es sur le fret et le moyen de transport \u00e0 l\u2019Agence des services frontaliers du Canada (ASFC) avant leur arriv\u00e9e. Le d\u00e9faut de se conformer peut entra\u00eener des sanctions impos\u00e9es sur chaque \u00e9l\u00e9ment faisant l\u2019objet de non-conformit\u00e9.<\/p>\n<p>L\u2019ASFC souhaite aussi rappeler aux transporteurs qu\u2019avec le d\u00e9ploiement du Manifeste \u00e9lectronique, la transmission des donn\u00e9es sur le fret et le moyen de transport avant l\u2019arriv\u00e9e s\u2019ajoute aux exigences en mati\u00e8re de mainlev\u00e9e. Les transporteurs qui souhaitent obtenir la mainlev\u00e9e de leurs marchandises au premier point d\u2019entr\u00e9e devront communiquer avec l\u2019importateur ou le courtier avant leur arriv\u00e9e au premier point d\u2019entr\u00e9e pour s\u2019assurer que leur demande de mainlev\u00e9e est soumise et qu\u2019elle est accept\u00e9e dans le syst\u00e8me de l\u2019ASFC. En ayant en dossier les IPEC et les donn\u00e9es du Manifeste \u00e9lectronique, conform\u00e9ment aux exigences, de m\u00eame que la demande de mainlev\u00e9e, le passage aux douanes pourra se faire de fa\u00e7on plus rapide et plus efficace.<\/p>\n<p>L\u2019Unit\u00e9 des services techniques aux clients commerciaux (USTCC) envoie des messages par courriel aux clients pour les informer des pannes de syst\u00e8me, des jours f\u00e9ri\u00e9s, des taux de change, des modifications tarifaires, des taux d\u2019int\u00e9r\u00eat, etc. Pour vous assurer de recevoir, en temps opportun, les avis de pannes de syst\u00e8me, faites parvenir une demande par courriel \u00e0 l\u2019adresse : <a href=\"mailto:tccu-ustcc@cbsa-asfc.gc.ca\" target=\"_blank\">tccu-ustcc@cbsa-asfc.gc.ca<\/a>.<\/p>\n<p>Nous vous informons que l\u2019ASFC a mis en place un plan d\u2019urgence en cas de pannes de syst\u00e8me. Le plan \u00e9tablit les proc\u00e9dures pour l\u2019importation des marchandises commerciales que les clients, y compris les transporteurs, les courtiers\/importateurs, les agents d\u2019exp\u00e9dition et les exploitants d\u2019entrep\u00f4t, peuvent suivre advenant une panne du syst\u00e8me.
