CITT Issues Notice of Expiry of Order Concerning the Dumping of Carbon Steel Welded Pipe

On April 4, 2018, the Canada International Trade Tribunal (CITT) announced that its order made on August 19, 2013 continuing, without amendment, its finding made on August 20, 2008, regarding the dumping of certain carbon steel welded pipe, is scheduled to expire on August 19, 2018.

The subject goods are described as carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range of ½ inch up to and including 6 inches (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively, originating in/or exported from the China.

Under the Special Import Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The expiry proceeding will be conducted by way of written submissions. Anyone wishing to participate as a party in these proceedings must file a notice of participation with the CITT on or before April 20, 2018. Counsel intending to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the CITT on or before April 20, 2018.

On April 23, 2018, the CITT will distribute the list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined in the Notice of Expiry of Order.

The CITT will issue a decision on May 24, 2018, on whether an expiry review is warranted. If an expiry review is not warranted, the order will expire on its scheduled expiry date. If the CITT decides to initiate an expiry review, it will issue a Notice of Expiry Review.
